GOOD EVENING TO THE SUPERINTENDENT, TO THE TRUSTEES AND THIS PACKED HOUSE, WHO HAVE COME TO FIND OUT MORE ABOUT HOW THE SCHOOL DISTRICT RUNS.

I STARTED COMING TO THESE MEETINGS, I DON'T KNOW, ABOUT TWO YEARS AGO BECAUSE I'VE BEEN HERE PROBABLY 15, 20 YEARS, AND I KEPT HEARING ALL THESE THINGS ABOUT FRISCO ISD, AND A LOT OF THEM WEREN'T REAL PLEASANT.

SO I THOUGHT, WELL, I JUST NEED TO SIT HERE. SO I HAVE FOR THE LAST TWO YEARS, AND IT'S BEEN VERY EDUCATIONAL. AND ONE MEETING RIGHT BEFORE DEBBIE GILLESPIE WAS NO LONGER ON THE BOARD STANDS OUT TO ME BECAUSE I GREW UP AS AN AMERICAN, WHERE EVERY FOUR YEARS YOU WOULD SEE ON TV VERY SOLEMN TONES.

WE NOW HAVE THE PEACEFUL TRANSFER OF POWER THAT YOU NEVER SEE AROUND THE WORLD.

AND THEN I WAS STRUCK BY THE ONE MEETING, ACTUALLY, I WAS GOING THROUGH THE FAQS, AND THEY BROUGHT THIS ATTENTION TO ONE OF THE BOARD MEMBERS.

AND HE SAID, THESE NEED TO BE CHANGED ANYWAY, AND THAT IS THAT.

WHO CAN PUT THE AGENDA ITEMS ON THE ON THE ON THE BALLOT? I'M SORRY. NOT THE BALLOT ON THE AGENDA. WHO CAN DO IT? AND IT SAYS IT TAKES TWO.

AND I GO, WAIT A MINUTE. THAT'S THE NOSKIN RULE.

AND THIS IS PROBABLY THE EPITOME OF NON AMERICAN VIOLATION OF WE THE PEOPLE WHO HIRE YOU, WHO EXPECT YOU TO FOLLOW THE RULES AND THAT WHICH YOU SWEAR TO FOLLOW, WHICH IS WHAT THE CONSTITUTION SAYS AND HOW IT IS, AND NOT CUT SOMEBODY OUT BECAUSE YOU DON'T LIKE THEIR IDEAS.

DURING THIS TIME. DURING THIS TIME, WE'RE GOING TO ASK THAT ANY TRUSTEES HAVE.

IF YOU HAVE ANYTHING THAT YOU'D LIKE TO SHARE, PLEASE DO SO.

MRS. SALAS. I WANTED TO SHARE THAT THIS WEEKEND WE HAVE APPROXIMATELY 60 STUDENTS THAT WILL BE TRAVELING TO HOUSTON TO COMPETE IN OUR STATE CHAMPIONSHIP WRESTLING. I'M TOLD THAT THERE IS A STUDENT REPRESENTING EVERY SINGLE ONE OF OUR HIGH SCHOOLS, SO IF YOU CAN THROW OUT SOME SUPPORT FOR THEM THIS WEEK, IF YOU KNOW ANY OF THE HIGH SCHOOL SWIMMERS AND NOT SWIMMERS, THAT'S MY OTHER REPORT. WRESTLERS, PLEASE SUPPORT THEM IF YOU CAN.

AND THEN THE OTHER THING IS REEDY AND WAKELAND WON THEIR DISTRICT 9-5A SWIMMING AND DIVING TITLES, AND SEVERAL OTHER SWIMMERS AND DIVERS RECEIVED INDIVIDUAL CHAMPIONSHIPS ALSO.

THANK YOU. ELAD. YES, I JUST WANTED TO SHARE THAT YESTERDAY, MS. SAMPLE, MS. SALAS AND I HAD THE OPPORTUNITY TO VOLUNTEER AT THE REFRESH NORTH TEXAS WHERE THEY HAND OUT THE PACKETS TO THE FAMILIES. AND SO IT'S A GREAT ORGANIZATION.

I PUT A LINK TO IT ON MY FACEBOOK PAGE IN CASE PEOPLE WANT TO SUPPORT.

BUT FOR THOSE WHO AREN'T AWARE, BECAUSE I WASN'T AWARE OF THIS ORGANIZATION BEFORE I JOINED THE BOARD, THEY HELP STUDENTS TO GET PERSONAL HYGIENE PRODUCTS.

TOOTHPASTE, TOOTHBRUSHES, DEODORANT, BODY WASH, ALL THOSE THINGS.

AND THEY SERVE FRISCO ISD STUDENTS AS WELL AS A COUPLE OTHER NEIGHBORING DISTRICTS.

THEY SERVE THOUSANDS OF STUDENTS. AND THEY DO A LOT OF REALLY GREAT WORK.

SO THEY HAVE WISH LISTS ON AMAZON AND WALMART, I THINK.

AND THEN YOU CAN ALSO DONATE CASH. BUT IT WAS A GREAT EXPERIENCE. I BROUGHT MY 9TH GRADER WITH ME, AND WE HAD A GOOD TIME MEETING THE FAMILIES WHO WERE ALSO GRATEFUL AND APPRECIATIVE.

AND WE ALSO HELPED RESTOCK THE SHELVES WHEN THE DRIVE THROUGH LANE GOT A LITTLE SLOW.

BUT IT WAS JUST A GREAT EXPERIENCE AND I'M GRATEFUL THAT WE HAD THE CHANCE TO DO THAT YESTERDAY.

MRS. SAMPLE. THANK YOU, MS. ELAD, FOR SAYING THAT.

I DID ENJOY FRISCO REFRESH NORTH TEXAS, BECAUSE IT'S JUST A COMMUNITY SERVICE.

AND THAT'S ONE THING THAT JUST MAKES YOU HAVE A GOOD HEART.

I ALSO HAD THE OPPORTUNITY TO VISIT TO SEE THE LAWLER MIDDLE SCHOOL SEND-OFF.

THEY ARE ACTUALLY GOING TO STATE COMPETITION IN ORCHESTRA, AND THEIR PERFORMANCE WAS OUTSTANDING FOR MIDDLE SCHOOL. THEY MOVED THE INSTRUMENTS AROUND ON THE FLOOR.

THEY HAD SINGING. THEY HAD SOLOS. SO I JUST THOROUGHLY ENJOYED THE SEND-OFF.

THE SEND-OFF WAS JUST A LITTLE TASTE OF WHAT THEY'RE GOING TO DO AT THE COMPETITION, AND I JUST CAN'T WAIT TO SEE HEAR THE OUTCOME.

MR. MANDUVA. YEP. THANK YOU. THE LAST WEEK I THINK WITH A FEW OTHER FELLOW TRUSTEES, WE HAD THE OPPORTUNITY TO MEET SUPERINTENDENT YOUTH COUNCIL LUNCHEON. SO AT CTE CENTER I THINK WE ARE. WE HAD ONE ON ONE, NOT JUST ONE ON ONE, LIKE A GROUP CHAT WITH MULTIPLE GROUPS.

SO WE ASKED A QUESTION LIKE, WHAT. IF YOU WANT, LIKE ANY FUTURE COURSE, WHICH IS NOT OFFERED AT FRISCO ISD CURRENTLY, DO YOU HAVE ANYTHING? THEY SHARED LIKE A NICE, GREAT IDEAS I THINK I WOULD LIKE TO SHARE WITH DOCTOR CUNNINGHAM LATER LIKE SO.

YEAH, THEY HAD GREAT IDEAS, LIKE SOME COURSES WHICH NICE TO HAVE.

SO I THINK IT'S NICE TO INTERACT WITH ALL THE.

THEY'RE LIKE FRESHMEN, SOPHOMORES, JUNIORS, SENIORS, ALL IS A MIX OF ALL AND THE SUPERINTENDENT YOUTH COUNCIL AND REAL NICE TO MEET THEM.

WE WILL IN ALL LIKELIHOOD RETURN WITH A STATE CHAMPION OR TWO AFTER WITHIN THE NEXT WEEK OR SO.

I'M HIGHLY EXCITED ABOUT THAT. WE HAD OUR HALL OF HONOR INDUCTEE CEREMONY WITHIN THE LAST MONTH, AND SO THE ONES THAT WE HAVE GOING ON RIGHT NOW, WE GOT TO CELEBRATE THE ONES IN THE PAST THAT WERE TRULY EXTRAORDINARY.

AND THIS IS A RELATIVELY NEW PROGRAM. RIGHT, CORY? WHERE WE HAVE THE ABILITY TO KIND OF RECOGNIZE SOME OF THE EXCEPTIONAL STUDENT ATHLETES FROM YEARS PAST, AND WE HAD EVERYTHING FROM A 1940S WOMEN'S BASKETBALL TEAM TO A VERY RECENT NATIONAL CHAMPION VOLLEYBALL PLAYER THERE.

AND SO IT WAS REALLY REMARKABLE TO SEE THAT. I SUSPECT WE HAVE A LONG LIST OF HONOREES FOR YEARS TO COME IN THIS DISTRICT, AND MORE TO BE RECOGNIZED THIS YEAR AND IN YEARS TO COME AS WELL.

SO JUST WANTED TO CONGRATULATE ALL THOSE INDUCTEES INTO THE FRISCO ISD HALL OF HONOR.

THANK YOU TRUSTEE HILL. IN ADDITION TO WHAT ALL OF THE OTHER TRUSTEES HAVE MENTIONED WE'VE HAD A PRETTY FULL MONTH, BUT I WANTED TO SHARE THAT AT THE TOP OF LAST WEEK, I HAD THE OPPORTUNITY TO TRAVEL TO WASHINGTON, D.C. WITH 70 OTHER TRUSTEES ACROSS THE STATE OF TEXAS TO PARTICIPATE IN THE TEXAS FEDERAL ADVOCACY CONFERENCE.

IT WAS DURING THIS TIME I WAS ABLE TO LEARN MORE ABOUT HOW OUR FEDERAL GOVERNMENT WILL POTENTIALLY AFFECT THE SCHOOL DISTRICT AND DIFFERENT LAWS THAT ARE BEING PUT IN PLACE.

AND SO IT WAS A LOT OF INFORMATION. IT WAS A POWER PACKED DAY.

AND THEN I JUMPED ON THE FLIGHT TO GET BACK TO TEXAS ON TUESDAY MORNING.

SO I DID NOT HAVE AN OPPORTUNITY TO GO TO THE HILL WITH THE OTHER TRUSTEES, BUT I DID HAVE AN OPPORTUNITY TO ATTEND THE CONFERENCE.

IN ADDITION TO THAT, WE DO HAVE SOME MEMBERS OF OUR FRISCO INSIGHT GROUP HERE WITH US TONIGHT.

IT HAS TRULY BEEN A PRIVILEGE TO BE A PART OF THIS PROGRAM AND TO REPRESENT THE GRADUATING CLASS TONIGHT THROUGH FISD INSIGHT, OUR COHORT GAINED A DEEPER APPRECIATION FOR FRISCO ISD.

WITH EACH SESSION, WE SAW GENUINE CARE, DEDICATION AND PASSION ACROSS EVERY FRISCO ISD DEPARTMENT.

AS A PARENT, IT WAS REASSURING TO SEE THE CARE TAKEN TO KEEP OUR CHILDREN SAFE THROUGH PROACTIVE PLANNING AND CLEAR COMMUNICATION ACROSS THE DISTRICT. WHAT TRULY SURPRISED ME PERSONALLY WAS LEARNING HOW MUCH OF THE DISTRICT'S WORK IS SHAPED BY STATE AND FEDERAL LAWS, AND HOW THOUGHTFULLY EACH DEPARTMENT WEAVES THOSE REQUIREMENTS INTO ITS WORK, WHILE HONORING FISD MISSION OF KNOWING EVERY STUDENT BY NAME AND NEED. I BELIEVE I SPEAK ON BEHALF OF THE INSIGHT CLASS WHEN I SAY THIS PROGRAM HAS DEEPENED OUR COMMITMENT TO SUPPORTING THE DISTRICT'S WORK AND SERVING AS ADVOCATES FOR FRISCO ISD.

IN THE LAST FEW MONTHS, WE HAVE NOT ONLY GAINED A STRONGER UNDERSTANDING OF THE DISTRICT, BUT ALSO FORMED A COMMUNITY OF CIVIC MINDED INDIVIDUALS WHO CARE DEEPLY ABOUT THIS INSTITUTION. WE HAD ENOUGH BANKED MINUTES TO ACCOUNT FOR THE FIRST TWO DAYS ALREADY WITHIN OUR CALENDAR.

AND THEN, AS YOU KNOW, WE HAVE THE TWO BAD WEATHER MAKE-UP DAYS.

THE WAIVER WE'RE SEEKING WOULD ALLOW FOR US TO RECEIVE PERMISSION FROM TEA FOR AT LEAST PROBABLY TWO OF THOSE DAYS, THAT WE WOULD NOT HAVE TO UTILIZE THE BAD WEATHER MAKE-UP DAYS. THAT'S ON OUR CALENDAR. THAT WOULD ALLOW US TO GIVE A LITTLE BIT OF INSURANCE IN CASE THERE WAS SOME INCLEMENT WEATHER FROM NOW FOR THE REST OF THE SCHOOL YEAR.

AND ON TOP OF THAT, I KNOW DOCTOR FIORI AND HER TEAM HAVE WORKED PRETTY HARD TO MAKE CERTAIN THAT OUR STUDENTS AREN'T NEGATIVELY IMPACTED BY THE FOUR DAYS.

THE OTHER THING IS, AND WE TALKED ABOUT THIS HISTORICALLY, WE HAVE PRETTY MINIMAL ATTENDANCE ON ANY BAD WEATHER MAKE-UP DAYS THAT WE HAVE.

WE HAVE USED A FEW IN THE PAST NOT MANY BUT WE'VE USED A FEW.

AND SAME THING WITH OUR, OUR STAFF. SO FOR THOSE REASONS PLUS THE FACT THAT WE BELIEVE THERE WON'T BE NEGATIVELY IMPACTED FOR STUDENTS.

THAT'S WHY WE'RE RECOMMENDING THOSE TWO DAYS THANK YOU FOR SHARING THAT. BUT I HAD A COUPLE OF COMMENTS, KIND OF AS A FOLLOW UP.

SO FOR ME, I THINK PART OF THE REASON WHY PEOPLE WE DON'T HAVE GOOD ATTENDANCE ON THE BAD WEATHER MAKE-UP DAYS IS BECAUSE WE DON'T TYPICALLY USE THEM, AND PEOPLE DON'T THINK THAT WE MIGHT USE THEM.

AND SO I DON'T THINK WE'VE USED THEM SINCE I'VE BEEN ON THE BOARD AND I CAN'T REMEMBER TOO MANY TIMES SINCE I'VE BEEN A PARENT IN THIS DISTRICT WHERE WE'VE ACTUALLY USED THEM.

MY OTHER CONCERN IS, YOU KNOW, I, I PICK UP MY DAUGHTER EVERY DAY FROM SCHOOL OR MOST DAYS, AND I ASK HER, YOU KNOW, HOW WAS SCHOOL? AND I GET THE TYPICAL SHE JUST TURNED 15 OVER THE WEEKEND.

I GET THE TYPICAL NOTHING ANSWER RIGHT. I DID NOTHING TODAY FOR EIGHT HOURS AT SCHOOL, AND THEN WHEN I PROBE AND SAY, OKAY, WAS IT A DAY OR B DAY? WHAT'D YOU DO IN GEOMETRY? WHAT DID YOU DO IN AP HUMAN? WHAT DID YOU DO HERE? WHAT DID YOU DO THERE? THEN I GET THE ANSWERS AND I THINK THAT DAYS MATTER.

I UNDERSTAND MINUTES MATTER, BUT I ALSO THINK THAT DAYS MATTER.

AND I THINK THAT WE HAVE THE DAYS BUILT IN. AND IF WE'RE NOT GOING TO USE THEM, I'M NOT SURE WHY WE KEEP PUTTING THEM IN EVERY YEAR.

QUITE FRANKLY, I DON'T I DON'T KNOW WHY WE ARE DOING THAT BECAUSE WE DON'T USE THEM.

OF COURSE, STUDENTS HAVE THE RIGHT TO PRAY AND READ SCRIPTURE DURING THE SCHOOL DAY.

IN FACT, THEY ALREADY HAVE THOSE RIGHTS. THEY'VE HAD THOSE RIGHTS FOR RELIGIOUS EXPRESSION DURING THE SCHOOL DAY FOR MULTIPLE GENERATIONS IN FACT.

HERE IN FRISCO ISD, WE WORK TO HONOR THOSE FIRST AMENDMENT RIGHTS EVERY SINGLE DAY.

I THINK MOST EXPERIENCED EDUCATORS WILL TELL YOU THAT AS LONG AS THERE ARE BIG GAMES OR DIFFICULT TESTS OR POP QUIZZES, STUDENTS WILL BE PRAYING WHILE AT SCHOOL. I THINK MOST EXPERIENCED EDUCATORS WOULD ALSO AGREE THAT AS LONG AS STUDENTS WILL TRY TEACHERS, PATIENTS, SCHOOL STAFF WILL ALSO BE PRAYING AT SCHOOL.

THE RIGHTS OF STUDENTS AND STAFF TO PRAY AND READ SCRIPTURE IN SCHOOL IS WELL ESTABLISHED IN THIS COUNTRY AND IN THIS STATE.

THE FIRST AMENDMENT PROTECTIONS COME FROM TWO PARTS.

IN TERMS OF RELIGIOUS PRAYER. THE FIRST IS THE FREE EXERCISE PORTION OF THE FREE EXERCISE CLAUSE OF THE FIRST AMENDMENT.

AND THAT CREATES A GENERAL PRINCIPLE THAT PEOPLE HAVE A PRIVATE RIGHT TO EXPRESS THEMSELVES RELIGIOUSLY WITHOUT GOVERNMENT INTERFERENCE.

THAT MEANS THAT EACH INDIVIDUAL CAN EXPRESS THEIR OWN RELIGIOUS BELIEF THROUGH PERSONAL PRAYER AND WORSHIP.

THE SECOND PART OF THE FIRST AMENDMENT THAT AFFECTS US HERE IS THE ESTABLISHMENT CLAUSE, AND THAT WORKS IN HAND WITH THE FREE EXERCISE CLAUSE.

BY CLARIFYING THAT THE FIRST AMENDMENT PROHIBITS GOVERNMENT ACTION THAT ESTABLISHES ADVANCES OR COERCES RELIGION.

THE SUPREME COURT AND FEDERAL APPELLATE COURTS HAVE PROTECTED THESE FIRST AMENDMENT RIGHTS AS THEY APPLY TO THE.

TO PUBLIC SCHOOLS OVER THE COURSE OF MANY, MANY DECADES.

IN 1962, THE US SUPREME COURT RULED IN ENGEL V.

VITALE THAT STUDENTS HAD THE RIGHT TO PRAY AT SCHOOL AS LONG AS THE PRAYER IS STUDENT INITIATED AND NON-DISRUPTIVE.

IN 1995, THE FIFTH CIRCUIT, WHICH IS OUR CIRCUIT COURT OVER TEXAS, RULED IN DOE V.

DUNCANVILLE ISD THAT STUDENTS CAN PRAY IN GROUPS DURING NON-INSTRUCTIONAL TIME SO LONG AS THEY DON'T DISRUPT THE LEARNING OF OTHERS OR HARASS ANYONE.

IN 2015, THE U.S. SUPREME COURT RULED IN SANTA FE ISD V.

DOE THAT NOTHING IN THE US CONSTITUTION PROHIBITS A PUBLIC SCHOOL STUDENT FROM VOLUNTARILY PRAYING AT ANY TIME DURING THE SCHOOL DAY.

WE ALSO HAVE EXISTING STATUTES IN TEXAS, SPECIFICALLY IN THE TEXAS EDUCATION CODE, REINFORCING THESE FIRST AMENDMENT RIGHTS.

TEXAS EDUCATION CODE 25.091 STATES THAT ANY PUBLIC SCHOOL STUDENT HAS AN ABSOLUTE RIGHT TO PRAY OR MEDITATE INDIVIDUALLY, VOLUNTARILY, AND SILENTLY DURING THE SCHOOL DAY.

TEXAS EDUCATION CODE 25.154 PROVIDES THAT STUDENTS MAY ALSO ORGANIZE PRAYER GROUPS, RELIGIOUS GROUPS, AND OTHER RELIGIOUS GATHERINGS DURING THE SCHOOL DAY, TO THE SAME EXTENT THAT STUDENTS CAN ENGAGE IN OTHER TYPES OF NON-RELIGIOUS ACTIVITIES.

ON OUR CAMPUSES HERE IN FRISCO ISD, WE IMPLEMENT THOSE STATE LAWS EVERY SINGLE DAY TO PROTECT THE RIGHTS OF OUR STUDENTS TO PRAY.

FOR EXAMPLE, WE HAVE RELIGIOUS STUDENT LED RELIGIOUS CLUBS ON EVERY SINGLE ONE OF OUR HIGH SCHOOL CAMPUSES.

AND IN SEPTEMBER OF EVERY YEAR, STUDENTS AT ALL GRADE LEVELS GATHER AROUND CAMPUS FLAGPOLES DURING THE SEE YOU AT THE POLE NATIONAL PRAYER EVENT.

WHEN OUR STUDENTS ASK FOR A QUIET PLACE TO PRAY DURING NON-CLASS TIME, THE SCHOOLS WORK CAREFULLY WITH THOSE PARENTS, WITH THE STUDENTS AND THEIR PARENTS TO PROVIDE THEM WITH SPACES TO PRAY.

WE ALSO ALLOW STUDENTS TO GO TO THE LIBRARY OR ALTERNATIVE LOCATIONS FOR LUNCH IF THEY'RE FASTING FOR RELIGIOUS REASONS.

STUDENTS ARE FREE TO READ THE BIBLE OR ANY RELIGIOUS TEXT OF THEIR CHOOSING DURING THE SCHOOL DAY, AT ANY TIME WHEN THEY'RE NOT DOING OTHER ACTIVE LEARNING.

NOTHING IN THE LAW OR FRISCO ISD POLICY PROHIBITS A STUDENT FROM READING THE BIBLE, THE TORAH, THE QURAN, THE BHAGAVAD GITA, OR ANY OTHER RELIGIOUS TEXT BEFORE OR AFTER SCHOOL DURING ADVISORY.

WHEN THEY FINISH THEIR WORK IN CLASS OR DURING SILENT VOLUNTARY CHOICE READING.

AS A SCHOOL DISTRICT, WE ALSO HONOR AND PROTECT THE FIRST AMENDMENT RIGHTS OF OUR EMPLOYEES.

EMPLOYEES RELIGIOUS RIGHTS ARE OBVIOUSLY NOT AS BROAD AS STUDENTS RIGHTS UNDER THE FIRST AMENDMENT BECAUSE AS A SCHOOL DISTRICT EMPLOYEE, WHEN A DISTRICT EMPLOYEE IS ACTING IN THEIR OFFICIAL CAPACITY, THEY'RE A REPRESENTATIVE OF THE GOVERNMENT, AND THEY SHOULD AVOID ANY RELIGIOUS ACTIVITY THAT WOULD BE COERCIVE OF OUR STUDENTS, AS THAT WOULD VIOLATE THE ESTABLISHMENT CLAUSE THAT WE TALKED ABOUT EARLIER.

BUT EMPLOYEES ARE STILL FREE TO DISCUSS THEIR PERSONAL FAITH AT WORK.

THEY CAN DO THIS WHILE ON CAMPUS. DURING THEIR FREE TIME AWAY FROM STUDENTS.

EMPLOYEES CAN EVEN MEET IN PRAYER GROUPS WITH EACH OTHER IN BIBLE STUDY, DURING LUNCH, BEFORE SCHOOL OR AFTER SCHOOL TO PRAY AND READ SCRIPTURE WITH THEIR FELLOW EMPLOYEES. AS LONG AS THEY'RE NOT FORCING THEIR FAITH ON OTHERS OR HARASSING ANOTHER PERSON.

THAT RIGHT WAS AFFIRMED IN 2022 BY THE U.S. SUPREME COURT IN KENNEDY V.

BREMERTON SCHOOL DISTRICT, WHICH ALLOWED FOR A FOOTBALL COACH TO ENGAGE IN PRIVATE PERSONAL PRAYER AT WORK EVEN THOUGH IT WAS ON THE FOOTBALL FIELD AROUND THE TIME OF A FOOTBALL GAME. THAT RIGHT TO PRAY WAS PROTECTED AS LONG AS HIS STUDENTS WERE OTHERWISE OCCUPIED.

HE WASN'T RESPONSIBLE FOR SUPERVISING THE STUDENTS AT THAT TIME, AND HE WAS FREE TO ENGAGE IN OTHER PRIVATE COMMUNICATIONS, LIKE A PERSONAL PHONE CALL. UNDER THOSE CONDITIONS, HE ABSOLUTELY HAD THE RIGHT TO PRAY EVEN WHILE ON SCHOOL GROUNDS AT A SCHOOL SPONSORED EVENT. ADDITIONALLY, UNDER TITLE VII, EMPLOYEES HAVE THE RIGHT TO REQUEST RELIGIOUS ACCOMMODATIONS, AND OUR DISTRICT WORKS WITH EMPLOYEES TO PROVIDE THOSE ACCOMMODATIONS SO EMPLOYEES CAN PRACTICE THEIR FAITH EVEN WHILE THEY'RE AT WORK.

AS YOU CAN HOPEFULLY TELL, FRISCO ISD WORKS VERY HARD ALREADY TO HONOR THE FIRST AMENDMENT RELIGIOUS RIGHTS OF OUR STUDENTS AND STAFF.

WE HONOR THE RIGHT TO EXPRESS THEIR FAITH WITHIN THE SCHOOL SETTING CONSISTENT WITH FEDERAL AND STATE LAW.

AND THAT INCLUDES THROUGH EIGHT BOARD POLICIES AFFIRMING OUR STUDENT AND STAFF FIRST AMENDMENT RIGHTS TO RELIGIOUS EXPRESSION.

WHEN YOU LOOK BEYOND THE TITLE OF THE BILL OF SB 11 AND REALLY DIG INTO ITS TEXT, IT DOESN'T SERVE TO ADVANCE THOSE RIGHTS OF OUR STAFF AND STUDENTS. NOT ONLY DOES IT NOT ADVANCE THOSE RIGHTS, IT'S ALSO PROBLEMATIC UNDER EXISTING FIRST AMENDMENT CASE LAW AND THE PRACTICAL CIRCUMSTANCES OF RUNNING A SCHOOL. IF A SCHOOL BOARD CHOOSES TO ADOPT A PERIOD OF PRAYER UNDER SB 11, THE LAW REQUIRES THE PUBLIC SCHOOL DISTRICT TO TAKE SPECIFIC STEPS FOR THAT PRAYER TIME, WHICH ARE OUTLINED IN THE STATUTE.

FIRST, BEFORE A STUDENT CAN PRAY DURING THAT PRAYER PERIOD.

THE STUDENT'S PARENTS HAVE TO SIGN A WRITTEN CONSENT AND A WAIVER OF THEIR RIGHTS TO FILE A SUIT AGAINST THE SCHOOL DISTRICT OR THE STATE OF TEXAS UNDER STATE OR FEDERAL LAW, OR AND IT EXPLICITLY SAYS, FOR A VIOLATION OF THE U.S.

CONSTITUTION'S ESTABLISHMENT CLAUSE. AS A REMINDER, THAT ESTABLISHMENT CLAUSE IS WHAT PREVENTS GOVERNMENTS, INCLUDING PUBLIC SCHOOL DISTRICTS, FROM ESTABLISHING, ENDORSING, OR COERCING RELIGIOUS OBSERVANCE.

THE GOVERNMENT CAN'T CREATE A RELIGION OR FAVOR ONE RELIGION OVER ANOTHER.

THAT PRINCIPLE WAS VITALLY IMPORTANT TO OUR COUNTRY'S FOUNDING FATHERS, MANY OF WHOM CAME TO THIS LAND ESCAPING RELIGIOUS PERSECUTION FROM THEIR HOME COUNTRIES AS AMERICANS, AS EDUCATORS, AND AS ELECTED REPRESENTATIVES WHO PLEDGED TO UPHOLD THE CONSTITUTION.

WE SHOULD BE VERY WARY OF REQUIRING STUDENTS AND PARENTS TO WAIVE THEIR CONSTITUTIONAL RIGHTS IN ORDER TO PRAY DURING THE SCHOOL DAY.

SECONDLY, SB 11 REQUIRES THAT SCHOOL STAFF ENSURE THAT THOSE WHO HAVE A CONSENT TO PRAY ARE SEPARATE FROM THOSE WHO DO NOT HAVE A CONSENT TO PRAY AND ARE NOT IN EARSHOT OR EYESIGHT OF THOSE WHO ARE PRAYING.

IN OTHER WORDS, SB 11 REQUIRES THAT WE PROVIDE SEGREGATED SPACES WHERE CHILDREN OF FAMILIES WHO HAVE CONSENTED TO PRAYER ARE PHYSICALLY SEPARATED FROM CHILDREN OF FAMILIES WHO DIDN'T SIGN A CONSENT FORM AND WAIVE THEIR RIGHTS UNDER THE CONSTITUTION.

THIS ACT ENABLES STUDENTS PUTTING THEM AT RISK OF AN US VERSUS THEM ATTITUDE IN OUR SCHOOL AND PUTS OUR STAFF AT RISK OF DERISION, COMPLAINT AND LICENSURE CONCERNS SIMPLY BY TRYING TO ENFORCE THE LEGALLY REQUIRED SEPARATION OF STUDENTS ON RELIGIOUS GROUNDS.

REMEMBER, ONLY STUDENTS WHOSE PARENTS SIGNED A CONSENT WILL HAVE WAIVED THEIR RIGHT TO SUE A SCHOOL DISTRICT OR SCHOOL DISTRICT EMPLOYEE, NOT THOSE STUDENTS WHOSE PARENTS HAVE NOT SIGNED SUCH A CONSENT FORM.

PUTTING OUR STAFF MEMBERS AT JEOPARDY! THIRD, SENATE BILL 11 DOES NOT ALLOW FOR A PERIOD OF PRAYER TO TAKE AWAY FROM INSTRUCTIONAL MINUTES. THIS IS A PRACTICAL CONCERN AT THE ELEMENTARY LEVEL.

ALL OF OUR INSTRUCTIONAL MINUTES ARE ALREADY ALLOTTED TO INSTRUCTION.

THAT'S THE SCHOOL DAY IS FULLY PACKED FOR OUR LITTLE KIDDOS, AND THAT WOULD MEAN THAT IF WE WERE TO ADD A PRAYER PERIOD DURING OUR DAY, IT WOULD REQUIRE THE EXTENSION OF A SCHOOL DAY FOR OUR ELEMENTARY EMPLOYEES AT NO COMPENSATION, SINCE THERE'S NO ADDITIONAL FUNDS ADDED FOR THIS IN THE STATE LEGISLATURE.

AND IT WOULD ALSO REQUIRE OUR LITTLE STUDENTS WHO ARE ALREADY STRUGGLING TO MAKE IT THROUGH A LONG SCHOOL DAY, TO HAVE AN EVEN LONGER SCHOOL DAY. FOURTH, SENATE BILL 11 DOESN'T HAVE DIFFERENT RULES FOR THOSE BASED ON AGE OR MATURITY OF OUR STUDENTS.

FRISCO ISD TEACHES STUDENTS FROM PRE-K ON, AND WE ALL KNOW HOW IMPRESSIONABLE YOUNG ELEMENTARY STUDENTS CAN BE.

THEY OFTEN WANT TO PLEASE THEIR TEACHERS AND IMPRESS THEIR FRIENDS.

BECAUSE YOUNG STUDENTS ARE SO IMPRESSIONABLE, THEY'RE PARTICULARLY VULNERABLE TO COERCION IN THE RELIGIOUS CONTEXT.

BECAUSE SENATE BILL 11 DOESN'T CONTEMPLATE DIFFERENCES IN IMPLEMENTATION BETWEEN ELEMENTARY AND HIGH SCHOOL STUDENTS, IT LEAVES OUR ELEMENTARY STUDENTS PARTICULARLY VULNERABLE.

WE SHOULD BE VERY WARY OF YOUNG AND IMPRESSIONABLE STUDENTS ENGAGING IN RELIGIOUS PRACTICE UNDER THE SUPERVISION OF SCHOOL STAFF AWAY FROM THEIR PARENTS, EVEN IF THE PARENT HAS SIGNED A WAIVER OF THEIR RIGHT TO SUE US BECAUSE PARENTS, NOT THE GOVERNMENT, SHOULD DIRECT THE THE RELIGIOUS UPBRINGING OF THEIR CHILDREN.

AGAIN, FRISCO ISD ALREADY PERMITS OUR STUDENTS AND STAFF TO ENGAGE IN RELIGIOUS EXPRESSION TO PRAY OR READ SCRIPTURE DURING THE SCHOOL DAY.

STUDENTS AND STAFF ARE FREE TO CONTINUE EXERCISING THOSE RIGHTS, WHETHER OR NOT THE BOARD ADOPTS A RESOLUTION UNDER A SENATE BILL 11.

BECAUSE OF THE LEGAL AND PRACTICAL CONCERNS WITH STATE SPONSORED PERIOD OF PRAYER IN PUBLIC SCHOOL, AND BECAUSE OF THE ROBUST FIRST AMENDMENT PROTECTIONS ALREADY IN PLACE UNDER STATE AND FEDERAL LAW, AS WELL AS FRISCO ISD'S EXISTING POLICIES. THE FRISCO ISD ADMINISTRATION RECOMMENDS THAT THE BOARD DECLINE TO ADOPT A RESOLUTION PER SENATE BILL 11 AND INSTEAD AFFIRM FRISCO ISD'S EXISTING POLICIES PROTECTING THE FIRST AMENDMENT RIGHTS OF OUR STUDENTS AND STAFF.
